Where do overseas Vietnamese vote?

Question: "I am an overseas Vietnamese living in the Russian Federation. I visit the homeland on the occasion of the Election, do I have the right to cast a vote?"

Answer:

According to the provision of Clause 1, Article 29 of the Law on Election of Deputies to the NA and People's Council on the principle of making lists of voters: "Every citizen has the right to vote, is enrolled in the list of voters and can get voter card, except cases prescribed at Clause 1, Article 30 of this Law."

Pursuant to this, people disenfranchised of voting rights under the judgement and decisions of the court, which has taken legal effect; people sentenced to death awaiting their punishment; people are serving imprisonment without probation, and people who have lost their capacity for civil acts will not be enrolled in the list of voters.

The Clause 4, Article 29 of this Law stipulates: "Vietnamese citizen in foreign countries who return to Vietnam, from the time the Election is announced to at least 24 hours before the vote, can go to communal level people’s committee to show their passports recording their Vietnamese nationality to be named on the list of voters and get a voter card to elect deputies of the NA and People's Council at provincial, district and communal level (if they show their passport of Vietnamese nationality at the place of permanent residence registration) or to elect deputies to the NA and People's Council at provincial and district level (if they show their passport of Vietnamese nationality at the place of temporary residence registration)".

Pursuant to the above provision, if you still have Vietnamese nationality and are not in the cases of being barred from the list of voters, you have right to vote as other domestic citizens. To exercise this right, within 24 hours before the moment of starting the election, you need to go to commune-level People's Committee where you register temporary residence when returning to Vietnam to produce your passport, propose to add your name to the list of voters and get your voters card to elect deputies to the NA and People's Councils at provincial and district level./.
